Advice on Mixed Legal and Financial Issues and Expert Witness Services
Amicus does not provide legal advice, however our financial expertise in the areas of structured products and securitisation is employed on an ongoing basis to help resolve many mixed financial and legal disputes. We have been formally retained to provide expert witness assignments on ten occasions including a court appearance as an expert in the Ceramic Fuel Cells vs Oakvale Capital case in the Supreme Court of Victoria in 2010. In addition we have worked on many more issues on an informal basis providing initial scoping to determine whether any formal actions are warranted.
Claims against Lehman Brothers Australia and Other Parties
Amicus has helped over 40 different clients through the claims resolution and proof of debt processes for structured investments purchased from Lehman Brothers Australia prior to the GFC. Over 95% of clients were successful in making a recovery and in many cases, Amicus was able to secure a higher offer from the liquidator than was initially assessed. In total, Amicus clients have recovered over $32 million with more dividends still to be paid.
Amicus was also recently successful in securing additional monies for clients in a settlement with S&P ratings agency. Amicus has also helped resolve disputes with major banks with all client claims settling out of court.
